The Road Junky Sahara Retreat
1. Organizer
The Road Junky Sahara Retreat (the “Retreat”) is an event name under which the retreat is offered.
The retreat is organized and delivered by Tom Glaister, acting as an independent freelance retreat organizer / sole trader (the “Organizer”).
By booking and participating in the Retreat, you enter into a contract with the Organizer and agree to these Terms & Conditions.
2. Nature of the Retreat & Assumption of Risk
The Retreat takes place in a desert and remote environment in Morocco and includes activities such as walking in sand dunes, camel-supported travel, outdoor workshops, music, and group gatherings.
Participants acknowledge that participation involves inherent risks, including but not limited to physical exertion, uneven terrain, weather conditions, remoteness, limited access to medical facilities, and environmental factors.
Participation is voluntary. Participants confirm that they are physically and mentally fit to take part and that they assume responsibility for assessing their own capabilities and limitations.
3. Limitation of Liability
To the fullest extent permitted by applicable law, the Organizer shall not be liable for any injury, illness, loss, damage, accident, delay, or expense suffered by a participant in connection with participation in the Retreat, except where such liability arises from the Organizer’s proven gross negligence or intentional misconduct.
The Organizer is not responsible for:
-
Personal injury or health issues
-
Loss, theft, or damage to personal property
-
Actions or omissions of third parties (including transport providers, accommodation providers, guides, or service suppliers)
-
Circumstances beyond the Organizer’s reasonable control
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable consumer protection law.
4. Participant Responsibility & Indemnity
Participants agree to take reasonable care of themselves and others during the Retreat and to follow safety instructions provided by the Organizer or local guides.
Participants agree to indemnify and hold harmless the Organizer from any claims, losses, damages, or expenses arising from their own actions, omissions, or breach of these Terms, to the extent permitted by law.
5. Travel, Weather & Force Majeure
Participation in the Retreat requires independent travel to and from Morocco. Participants are solely responsible for arranging their own travel, including flights, ground transportation, visas, passports, insurance, and compliance with entry and border requirements.
The Organizer is not responsible for any inability to attend the Retreat resulting from circumstances beyond the Organizer’s reasonable control, including but not limited to:
-
Adverse or extreme weather conditions
-
Flight delays or cancellations
-
Airline, airport, or transportation disruptions
-
Border closures or government measures
-
Strikes, natural disasters, or other force majeure events
Weather conditions in desert environments may affect travel routes, transportation schedules, and access to locations. Participants acknowledge that weather-related disruption is an inherent risk of travel and participation.
Where the Retreat is able to take place substantially as described at the destination, the Organizer’s obligations shall be considered fulfilled, even if one or more participants are unable to attend or arrive due to travel disruption, weather, or force majeure circumstances.
6. Cancellation & Refund Policy
Payments for the Retreat are non-refundable in the event of non-attendance due to travel disruption, weather-related issues, personal circumstances, or other reasons beyond the Organizer’s control.
If the Retreat is cancelled or significantly altered by the Organizer due to a force majeure event, the Organizer will act in accordance with applicable consumer protection laws. Where refunds are legally required, they will be limited to amounts not already committed to non-recoverable costs. Where refunds are not legally required, any refunds, credits, or alternative arrangements may be offered as a gesture of goodwill but are not guaranteed.
7. Travel Insurance
Participants are strongly advised to obtain comprehensive travel insurance covering trip cancellation, interruption, delay, medical expenses, personal injury, and force majeure events, including adverse weather.
Failure to obtain appropriate insurance is the sole responsibility of the participant.
8. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws applicable in the Organizer’s country of residence, without prejudice to mandatory consumer protection rights applicable under EU law.
9. Acceptance of Terms
By booking and participating in the Retreat, participants confirm that they have read, understood, and agreed to these Terms & Conditions and acknowledge the risks involved in participation.
